Green Card: EB3 visa numbers Retrogress

The lastest Visa buleeting published by Department of State (DOS), announced that the Employment-Based- EB3(Skilled Workers/professionals) visa numbers for India, mainland China, and Philippines will retrogress as on January 1, 2005.
The EB3 numbers for nationals of the listed countries will retrogress to January 1, 2002.

What does this mean :
This means that, as of January 1, 2005, anyone who is the beneficiary of a labor certification or I-140 if a labor certification was not required in EB3 category, filed on or after January 1, 2002, will not be permitted to file the Asjustment of status(I-485) or a consular Processing( CP) interview until the numbers move beyond this date or in other words priority date becomes current.

Disadvantges:

1. Not allowed to file 485 means no EAD and No Advanced Parol
2. Will have to wait till these priority dates becomes current and visa numbers are allocated to this category.

Those who already filed 485 before Jan 2005 ?

Those who already filed I-485 before this date should be able to get the EAD and permission to Travel ( AP) . Can also renew EAD or work authorization
However, the I-485 could not be approved until the date again becomes current.
